West Virginia auto insurance laws require proof of insurance in the form of a (WV-1) Certificate of Insurance.  In addition, auto insurance policies must be issued by a company licensed to sell insurance in West Virginia. There are no exceptions to this rule, and West Virginians who choose not to adhere to these laws could face the SR-22 requirement, among other consequences.

The SR-22 is a certification from an auto insurance company that you have purchased the needed insurance and that it is in effect. It is also a certification that the auto insurance company will notify the West Virginia DMV should the insurance be cancelled or lapse for any reason. Notification usually occurs electronically and immediately. Should this happen, DMV will suspend the person's license .

In order for a SR-22 to valid it must be obtained from an auto insurance company that is licensed in West Virginia. Out-of-state SR-22's are not valid and may not be used.
